Lectures in Commercial Law
السداسي الثاني

Commercial Law is considered an independent branch of Private Law. It regulates the legal rules applicable to commercial acts and the category of traders, grounded in the principles of speed and credit. Its objective scope revolves around the classification of commercial acts according to the criteria of speculation and circulation, distinguishing between commercial acts by nature, by form, by accessory, and mixed acts. Furthermore, it defines the legal framework for the requirements of acquiring trader status and the consequent special legal regime, which includes the obligation to register in the Commercial Registry, maintain accounting books, and submission to insolvency regulations. This curriculum also addresses the legal frameworks of the "Fonds de Commerce" (Business Premises) as an intangible movable property, outlining its tangible and intangible elements, such as customer contact and goodwill.
